Aircraft registration cancellation
Certificate of registration cancels automatically (no owner application) on any of these events (CAR 202.57).
Cancelled where (CAR 202.57(1)):
| Event | Cite |
|---|---|
| Individual registered owner dies | 202.57(1)(a) |
| Entity registered owner wound up, dissolved, or amalgamated with another entity | 202.57(1)(b) |
| Filed lease termination date extended, and Minister not informed in writing within 7 days after the extended termination date | 202.57(1)(c) |
| Aircraft not operated in flight in last 5 years (except aircraft under restoration or an ultra-light aeroplane) | 202.57(1)(e) |
Custody and control (CAR 202.57(2), 202.35):
| Event cancelling certificate | Saved by | Notice to Minister | Ref |
|---|---|---|---|
| Document giving owner legal custody and control (e.g. lease) ends | Owner retains custody and control after | Within 7 days, in writing: date it ceased, plus copy of new document | 202.57(2) |
| Transfer of any part of custody and control | None | Owner notifies in writing within 7 days of transfer | 202.35(1), (2) |
- 202.57(2) exception: owner must do both (retain custody and control, and notify within 7 days). Retaining custody alone, or notice alone, is not enough.
- 202.35: unlike 202.57(2), keeping part of custody does not save it.
- 202.35(1) is subject to Subpart 3, leased aircraft by a non-registered owner.
Export (CAR 202.38, TC AIM LRA 4.7):
- Export of Canadian-registered aircraft ends registration.
- Sale/lease export conditions met first (remove Canadian marks, notify Minister, etc.).
- TC then removes aircraft from the Canadian Civil Aircraft Register and forwards cancellation notification to importing country's aviation authority.
- Only on registered owner's request, after conditions are met.
Trap: most CAR 202.5x notices run on a flat 7-day clock; export cancellation notification has no fixed deadline, TC sends it only once export conditions are met.
