Aviation document obligations (CAR 103)
CAR 103 duties for all Canadian aviation documents:
| Duty | Rule | Cite |
|---|---|---|
| Inspection | Owner or operator makes aircraft available for inspection on reasonable notice from the Minister | CAR 103.02(1) |
| Production on demand | Produce on demand for peace officer, immigration officer, or the Minister | CAR 103.02(2) |
| No lending | No lending to, or use by, a person not entitled to it under the Regulations | CAR 103.02(3)(a) |
| No mutilating | No mutilating, altering or making illegible | CAR 103.02(3)(b) |
| Return | After suspension or cancellation: person to whom it was issued returns document to Minister immediately after effective date | CAR 103.03 |
Production duty applies to:
- Holder of a Canadian aviation document
- Owner, operator or pilot-in-command of an aircraft for which one is kept
- Anyone possessing such a document, technical record, or other document
- Pilot: produce permit or licence on demand for designated Transport Canada officials, peace officers, or immigration officers (TP 1102)
"Other document" is deliberately broad (CAR 103.02(4)):
- All writings, papers and records made, held or maintained by owner, operator or pilot-in-command
- Records of any action, activity, performance or use of aircraft or crew
- Covered whether or not the law requires them
- Example: informal maintenance note or voluntary private flight log
Trap: "other document" catches records never legally required, and return is immediate on the effective date, not deferred to the next renewal or triggered only by a second request.
